Terms & Conditions

Newdeals.com.au and its apps and sub-domains (the “Site”) is a marketplace platform owned and operated by Drive Now WA Pty Ltd ABN 54 665 462 831 (“Newdeals”), where you can browse, select and purchase products sold by third-party sellers (“Sellers”) and also sell products as a vendor on our website. We also dropship products to you from other suppliers when you purchase products from us.

These terms and conditions are important, and you should read them carefully as they apply to your use of the Site, and by doing so you agree to be bound by them. There are some specific terms we wanted to make you aware of. These are set out below:

Site and Services Availability

We may change the Site, or stop making our services or the Site available without prior notice. See clause 3.1.

Cancelling Orders

Newdeals or its Sellers may reject or cancel your order after it has been placed, and you will be notified when this occurs and receive a refund for your order. Whether or not you can cancel an order placed with a Seller depends on the Seller’s own policies. If you are buying the Product from us, we may only allow you to cancel your order if it has not yet been processed with our shipping partner. See clause 7.

Liabilities

Without limiting your consumer law rights, Newdeals:

• (i) is not liable to you for any indirect or consequential loss other than where such loss arises as a result of our own negligence or wilful misconduct;

• (ii) is not responsible for the agreement between you and the Seller, including for the acceptance of Orders and supply and delivery of Seller products; and

• (iii) our liability to you under these terms will be reduced to the extent you either caused or contributed to that loss or damage (see clauses 4 and 14 for more details).

Fees to Sellers

Newdeals earns fees from Sellers on Products sold. See clause 6.4.

Changing These Terms

We can change these terms and conditions at any time, but the terms in place at the time you placed your order will continue to apply. See clause 21.4.

ABOUT YOU

1.1. To use our Site and purchase Products on Newdeals, you must:

• be at least 18 years of age;

• reside in Australia;

• possess the legal right and ability to enter into a binding agreement with Newdeals and/or Seller with respect to any Products purchased on the Site; and

• use the Site in accordance with this Agreement.

REGISTRATION & GUEST CHECKOUT

2.1. You can purchase Products from our Site by either registering a User account (“Account”) or by using our guest checkout (“Guest Checkout”).
2.2. Registering an Account with us allows you to save your details for future purchases; access your past order details; manage your subscription preferences.
2.3. You must keep your Account login details, particularly your account password, confidential and secure.
2.4. Your Account is personal to you and cannot be transferred.
2.5. You agree that Newdeals may suspend or terminate your Account if we believe you have breached this Agreement or applicable laws.

OUR SITE, LICENCE AND RESTRICTIONS ON USE

3.1. We provide this Site as a Service to our Users and Sellers and reserve the right to change or modify the Site at any time, cease providing the services on the Site in whole or part, or stop making the Site available without prior notice.
3.2. You may only use the Site in accordance with this Agreement.
3.3. Users must not interrupt the operation of the Site or use it for illegal purposes.
3.4. Users must not upload any content that breaches laws, infringes intellectual property rights, or is offensive or defamatory.

OUR ROLE IN TRANSACTIONS

4.1. Newdeals is a marketplace platform where Users purchase Products from Sellers.
4.2. When a Seller’s Product is purchased via the Site, the User and Seller form a legally binding agreement for the sale and supply of the Product.
4.3. Products sold by Newdeals may be dropshipped from suppliers such as Dropshipzone.com.au or Costco Australia.
4.4. Sellers are solely responsible for their Products, including pricing, quality, safety, and compliance with applicable laws.

PRODUCTS

5.1. Information about Products on the Site is provided by Sellers or suppliers and may differ slightly from the actual Product.
5.2. All Products offered are subject to this Agreement and the relevant Seller Terms.
5.3. Newdeals and its Sellers reserve the right to change, suspend or remove any Product offer at any time.

ORDERING AND DELIVERY

6.1. By ordering Products, you agree to purchase them for the displayed price plus applicable fees and shipping charges.
6.2. Payment methods include credit card, debit card, PayPal, Apple Pay, Google Pay, Afterpay, and Zip.
6.3. All prices include GST.
6.4. Orders will be processed upon full payment.

CANCELLING ORDERS

7.1. Orders may be cancelled prior to dispatch by Newdeals or Sellers in certain circumstances (e.g., stock unavailability, pricing errors).
7.2. If your order is cancelled, you will receive a full refund for the cancelled Product.

RETURNS & WARRANTY

• We comply with Australian Consumer Law.

• Sellers may have their own policies on change-of-mind returns.

• Products sold by Newdeals may be eligible for returns within 30 days if unused and in original condition.

• Manufacturer warranties apply where provided.

LIABILITY

14.1. For Products purchased from Sellers, Sellers are responsible for providing remedies under Australian Consumer Law.
14.2. Newdeals excludes all liability except as required by law.

PRIVACY

Your personal information is handled in accordance with the Newdeals Privacy Policy.

MISCELLANEOUS

21.1. This Agreement is governed by the laws of Australia.
21.4. Newdeals reserves the right to modify these terms at any time. Continued use of the Site constitutes acceptance of the updated terms.
